			<content:encoded><![CDATA[Stuart is a businessman.<br />Business has not been particularly good recently and so Stuart decides to hire L.R Creations, which is a public relations company, to carry out a publicity campaign for his business.  The publicity campaign is to run for a period of eight weeks and L.R Creations are to bill Stuart for their work at the end of the eight week period at a rate of &#163;2,000 per week.<br /><br />After only three weeks, L.R Creations hears rumours that Stuart is in financial trouble. L.R Creations are concerned as their chargeable work amounts to &#163;6,000 already. L.R Creations decide to fax Stuart straight away. The fax is sent by L.R Creations at 1 p.m. on 3rd June and states that unless Stuart pays an interim fee of &#163;6,000 to cover their chargeable work so far together with a &#8216;payment to account&#8217; of a further &#163;10,000 as an advance for their future fees in relation to the remaining five weeks of work, L.R Creations will regard the contract as being at an immediate end.<br /><br />Stuart is upset to receive such a fax and immediately replies by fax at 1.30 p.m. on 3rd June stating that such rumours are entirely false and L.R Creations should confirm that they will perform the contract on the original terms by 5 p.m. that day (3rd June) or else Stuart will regard the contract as being at an end. <br /><br />L.R Creations respond at 6.30 p.m. on 3rd June and confirm that they are now satisfied with Stuart&#8217;s financial standing and that L.R Creations will perform the contract after all. Stuart responds to say that L.R Creation&#8217;s decision has come too late, that the contract is at end and that Stuart will sue L.R Creations for breach of contract.<br /><br />advice whether or not Stuart is entitled to regard his contract with L.R Creations as at an end, and the courses of action and remedies open to Stuart and/or L.R Creations as a result of him doing so. <br /><br />WHAT IS THE ANSWER?]]></content:encoded>

			<content:encoded><![CDATA[So as you guys are probably aware, there has been a lot of chat about the so called Tesco Law in recent months. Yes it's been brewing for a while (an innovation of new labour i believe), but I want to know what people's thoughts are on the subject?<br /><br />Think its a good idea? Will it make the legal industry more competitive for the consumer? Is it a good thing to allow firms to float?<br /><br />Or is it a bad thing? Is going to damage the profession? Do we really want to see small firms (and the ability to set up small firms which don't go bankrupt within half a second) disappear? Should the law societies do more to actively oppose it? Should big firms be allowed to dictate what the rest of the profession does?<br /><br />I find the topic particularly interesting, and I just wanted to see what other people's views were<br /><br />Cheers guys]]></content:encoded>

			<content:encoded><![CDATA[So you were all thinking...its the Summer Holiday...what numpty is posting about Law...well - you guessed it...its me!<br /><br />Courtesy of the BBC:<br /><br />http://www.bbc.co.uk/news/uk-scotland-10977281<br /><br />So, thats it...that most brilliant protection of the liberty of the subject from perpetual prosecution by the Crown courtesy of "Double Jeopardy" is set to be removed from Scots Law.<br /><br />What are the views of folk on this?<br /><br />It seems to be in contradiction with Protocol 7, Article 4 of the European Convention on Human Rights which states:<br /><br />"No one shall be liable to be tried or punished again in criminal proceedings under the jurisdiction of the same State for an offence for which he has already been finally acquitted or convicted in accordance with the law and penal procedure of that State".<br /><br />It also seems to be ex post facto in effect. <br /><br />Am I the only person that thinks this is a slight contradiction of a) the rule of law, and b) a bloody poorly contrived idea?]]></content:encoded>

I still do actually because I am just no good at using Westlaw. But I am a wiz at Firstpoint. I am wondering if a sort of swap thread might be useful - where people could swap downloaded judgements, each person contributing the one they could easily get? <br /><br />It might be a stupid idea but what do people think?]]></content:encoded>
